Bark.com Lead Disclaimer & Independent Professional Terms
1. Independent Professional Relationship (Non-Affiliation)
Sheila M Coaching LLC is an independent professional service provider. Any services provided are offered directly by Sheila M Coaching LLC and not by Bark.com.
Bark.com acts solely as a platform that facilitates introductions between consumers and independent professionals. Bark.com is not a party to any agreement, contract, or service provided by Sheila M Coaching LLC and does not supervise, direct, or control the services delivered.
All contractual obligations, services, outcomes, and responsibilities are solely between Sheila M Coaching LLC and the client.
2. Responsibility for Services
Sheila M Coaching LLC is solely responsible for the quality, delivery, and performance of all services provided.
Services are performed with reasonable care, skill, and diligence in accordance with applicable laws and professional standards. Results are not guaranteed and depend on client participation, circumstances, and effort.
3. Limitation of Liability
To the maximum extent permitted by law, Sheila M Coaching LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services provided.
Total liability for any claim arising from services shall be limited to the total amount paid by the client for the specific service giving rise to the claim.
Clients agree that Bark.com bears no liability for any services provided by Sheila M Coaching LLC.
4. Indemnification
Clients agree to indemnify and hold harmless Sheila M Coaching LLC from any claims, losses, damages, liabilities, or expenses arising from misuse of services, misrepresentation, or violation of these Terms.
Sheila M Coaching LLC similarly agrees to indemnify Bark.com as required under Bark’s Professional Terms of Service for matters arising from service delivery.
5. Data Use & Privacy (Leads from Bark)
Client information received through Bark.com or other lead platforms is used solely for:
-Responding to service inquiries
-Providing requested services
-Service-related communication
All data is handled in accordance with applicable data protection and privacy laws and Sheila M Coaching LLC’s
Privacy Policy.
Client data is not sold or shared for marketing purposes without explicit consent.
6. Licensing & Insurance Representation
Sheila M Coaching LLC represents that it holds any licenses or authorizations required to provide coaching services and maintains appropriate business practices consistent with a prudent professional operator.
Coaching services are educational and personal-development based and do not replace licensed medical, psychological, legal, or financial services.
7. No Employment or Agency Relationship
Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Sheila M Coaching LLC and Bark.com or between Sheila M Coaching LLC and the client.
8. Governing Law
These Terms are governed by the laws of the State of Florida.
